CDMC. Legal warning

General Conditions of Use

This document describes the conditions that all CDMC web-site users must accept.

This legal warning establishes the conditions of use for the web-site http://cdmc.mcu.es which the Centre for the Dissemination of Contemporary Music, as a production department at the National Institute for the Performing Arts and Music attached to the Ministry of Culture (CIF: Q-2818024-H) places at the disposal of Internet users, exercising the powers attributed to it by Article 6 of Royal Decree 2491/1996 of 5th December (Official State Bulletin -(BOE- of 20th December), domiciled in Madrid (28004) Plaza del Rey s/n.

For purposes that are exclusively informative and promotional, but never commercial, the web-site of the Centre for the Dissemination of Contemporary Music (hereinafter the CDMC) caters for the interest of the Ministry of Culture to promote and boost the artistic and creative activity of professionals and other individuals devoted to contemporary music.

In order to facilitate navigation and rapid access to its contents, the web-site is structured around various different sections. These sections are presented as an initial point of reference, but may be developed and modified over time, depending, above all, on the needs and suggestions of the users themselves.

The National Institute for the Performing Arts and Music (hereinafter, INAEM) attached to the Ministry of Education and Culture of Spain, offers this service subject to the following Conditions of Use.

The present General Conditions of Use do not rule out the possibility that certain services or utilities offered through the auspices of the (URL http://cdmc.mcu.es) may be subject to special conditions of use, which, nevertheless, may be consulted by users before they are activated.

Services Offered by the CDMC Web-Site

Through its contents portal, INAEM offers the following services to users:

INAEM may offer users new contents and additional facilities that enhance the services available to users.

Likewise, INAEM reserves the right to unilaterally cancel any of the contents, services and facilities that make up the web-site.

Responsibility for the Processing and Use of Contents on the Internet

INAEM does not guarantee the quality, accuracy, reliability, correctness or morality of the data, programmes, information or opinions, whatever their origin, that may circulate on the networks that the user might access via the CDMC web-site. The users expressly agree not to hold INAEM liable with regard to same.

Users assume exclusive responsibility for the consequences, damages or suits that may result from access to the web-site contents or their reproduction and dissemination.

INAEM shall not accept responsibility for any violations on the part of any user that may affect the rights of another user of the web-site or of third parties, including copyright, trademarks, patents, confidential information and any other intellectual or industrial property right.

This limited guarantee and the limitations on liability mentioned in the previous paragraphs shall not affect or prejudice the imperative rights that correspond to users, in accordance with their place of residence.

Responsibility Relating to the Use of Links Via the INAEM Portal

INAEM shall not be responsible for the technical availability or the contents of web pages that users may access by means of links included on the CDMC web-site.

INAEM shall not be responsible for any harm caused to users from the consultation or use of contents or services offered by web pages that may be accessed by means of a link included on the CDMC web-site.

Intellectual and Industrial Property

Users recognise that the elements and utilities contained on the CDMC web-site are protected by legislation relating to copyright and that the intellectual and industrial property rights correspond to the authors and to INAEM. Consequently, users undertake to respect the terms and conditions established by these General Conditions of Use, the users themselves bearing sole responsibility for their violation vis-à-vis third parties.

Users recognise that the reproduction, modification, distribution, commercialisation, de-compilation, disassembly, use of inverse engineering techniques or any other means of obtaining the source code of the page, not to mention transformation or publication of any non-authorised reference trial results relating to any of the elements or utilities that form part of the CDMC web-site, all constitute a violation of intellectual property rights, undertaking, therefore, not to carry out any actions of this kind.

The ownership and property rights corresponding to the web-site shall correspond to INAEM, in which respect users undertake not to remove or alter any distinguishing sign used as a trademark or trade name (graphic, logo, etc.), any element protected by copyright or any other warnings, legends, symbols or labels that may appear on the CDMC web-site.

Furthermore, users recognise that the information they are able to access by means of the services provided may be protected by intellectual or industrial property rights or similar rights. Subject to express agreement between the parties, users undertake to use the information solely for their own needs and not to commercially exploit the services, either directly or indirectly, that they may gain access to thanks to their use of the CDMC web-site or any of the results they might obtain from use of same.

Users undertake not to use the facilities and tools provided by the web-site in order to carry out or suggest activities that are prohibited by law. Furthermore, users undertake to accept responsibility for the fulfilment of these conditions in the case of any person or persons whom they may authorise to use the service.

Users shall refrain from any kind of behaviour regarding their use of the CDMC web-site that may violate the intellectual or industrial property rights of INAEM or of third parties, or that may harm or violate the honour, personal or family privacy or image of third parties, or that may be illicit or immoral and, in all cases, said users shall hold INAEM free from all liability regarding any claim, either judicial or extra-judicial, that may be presented against it as a result of said use.

Users shall refrain from using the CDMC web-site in order to destroy, alter, disable or damage the data, programmes or electronic documents belonging to INAEM, to its suppliers or to third parties, as well as refraining from introducing or disseminating on the Web all and any programmes, viruses, applets, Active X controls or any other tool or physical or electronic device that may cause or be susceptible to causing any kind of alteration to the Web, to the system or to the equipment belonging to third parties. Furthermore, any kind of activity or practice that violates the principles of good conduct generally accepted among Internet users is expressly prohibited.

INAEM's Responsibility Regarding the Functioning of the CDMC Web-Site

INAEM shall not be responsible for any harm caused to users should it prove impossible to provide the services described in these General Conditions of Use.

Neither shall INAEM be responsible for the inadequate functioning of the CDMC web-site when this is the result of maintenance work being carried out, incidents affecting international operators, defective configuration of users' equipment or insufficient capacity to run the computer systems required in order to make use of the web-site's services.

Confidentiality and Data Protection

In accordance with the provisions of Organic Law 15/1999 Regarding the Protection of Personal Details, dated 13th December, INAEM informs Registered Users of the existence of an automated personal data file that has been created by and for INAEM and that operates under its responsibility. The purpose of this data is to maintain and manage the body's relations with users, as well as to carry out informative measures, with a view to boosting the dissemination and cultural promotion of contemporary music in Spain.

INAEM informs Registered Users of their right to gain access to the personal data compiled by INAEM, as well as to rectify, contest and cancel this personal information. These rights of access, rectification, contestation and cancellation may be exercised by Registered Users, and where appropriate, by their representatives, by sending a written and signed request to the following address:

This request must contain the following details: the user's name and surname; the address for purposes of notification; the user's national identification document or passport number; and the corresponding request. In the case of representation, this must be proven by means of a certifying document.

INAEM undertakes to fulfil its obligation of storing and maintaining the confidentiality of personal details, and it shall take the necessary measures in order to prevent their alteration, loss or unauthorised processing and handling, in accordance with the provisions set out in the Regulations Regarding Security Measures for Automated Files Containing Personal Data, as approved by Royal Decree 994/1999 of 11th July.
